It is illegal to set up a casino if the server is on US soil. It is also illegal for the major credit card companies to pay online casino bills for US residents no matter where the server is located.

Pay the right ‘taxes’ to the right peoples and almost any establishment can be open for business in a matter of weeks.
It is a gray area of law, I am not an attorney, I do know some of those laws that exist and that can be circumvented by the right payments or the correct ‘gifts’ to whomever is in power at the time.
To ‘open’ a website, online business, that takes subscriptions is not a crime, long as the content is not a crime.

A mate of mine here in the UK,set up an online casino.
Within hours he was shut down.
